Anywhere you file for an Asylum in the USA, the same law applies and same procedures will take place. However, each officer or judge has his/her own perception regarding each case in front of him/her. That means, personal approach to each case will be different from one officer to others. Moreover, a person has to file asylum case in the jurisdiction that he/she is residing.

Can someone who is in USA (NY) ( in legal status ) since 5 yrs can file for asylum ? I think he/she should do it within a year, right ? Suggestions appreciated.
